What is an Employment Visa?
An employment visa is a type of nonimmigrant visa that enables a foreign national to enter the United States to pursue employment. Depending on the type of visa, individuals may be able to work for an employer, open their own business, or perform certain services such as teaching or engaging in research activities. Employment visas are typically granted for a specific amount of time and are subject to renewal.
Who is eligible for an Employment Visa?
In order to obtain an employment visa, the foreign national must be sponsored by their employer or another qualified entity. Additionally, they must meet certain criteria, such as having adequate qualifications for the job they will be performing. It is important to note that, depending on the type of visa, there may also be restrictions on the types of activities an individual can engage in while in the United States. Employment visas are highly regulated and require careful consideration, so it is important to consult with our qualified immigration attorneys at Panteva Law Group if you have any questions about how they may affect your situation.

About Work Visas
L-1A Visa
An L-1A visa allows foreign executives or managers to be transferred to their company’s offices in the United States in a non-immigrant capacity. It can also cover employees who are being moved to the United States to establish an affiliate office, a new branch, or a subsidiary office. Typically, the L-1A visa holder’s spouse and children under the age of 21 can join him or her in the United States with an L-2 visa.
H-1B (Specialty Occupation) Visa
Through the H-1B visa, employers can hire qualified workers from outside the country temporarily for specialty occupations. There is a cap of 65,000 H-1B visas every fiscal year; those with a U.S. master’s degree or higher have an additional 20,000 petitions. Panteva Law Group can help you apply for an H-1B visa or seek an H-1B on behalf of prospective corporate employees.
P Visa
Those who come to the U.S. temporarily to take part in a recognized athletic competition may be eligible for a P-1A visa. These athletes can participate in a solo competition or as part of a group or team. The competition must be at an internationally recognized performance level for applicants to qualify for the visa.
EB-5 (Investor) Visa
Under the EB-5 investor visa program, administered by the United States Citizenship and Immigration Services (USCIS), immigrants who are willing to invest in the U.S. economy by starting a business and creating jobs for U.S. workers may be able to qualify for a green card (permanent residence).
EB-2 and EB-3 (Permanent Work) Visas
There are around 140,000 visas available each year for those who wish to immigrate to the United States in an employment-related capacity. With the right combination of experience, education, and career skills, you or your employees could be eligible to become a permanent resident in the United States.
Certain visas require that you already have a job offer from an employer in the United States. In this case, the employer is your sponsor and must acquire a labor certification from the U.S. Department of Labor (DOL).
O-1 (Extraordinary Abilities) Visa
To obtain an O-1 visa to come to the United States, those who are considered to have extraordinary abilities and have been recognized on a national or international level for their achievements in:
- Athletics
- The sciences
- Education
- Art
- Motion pictures
- Television
- Business
TN (Trade NAFTA) Visa
A TN Visa is a non-immigrant visa category available to eligible Canadian and Mexican professionals who seek temporary entry into the U.S. for employment purposes. It is designed to facilitate efficient cross-border trade and business activities.
EB-1 (Employment-Based, First Preference) Visa
An EB-1 visa is an employment-based immigrant visa that provides the holder with permanent residency. This visa is granted to aliens who possess extraordinary abilities and have proven national or international acclaim.
Many immigrants desire the EB-1 visa because the wait time is often a lot shorter than for other employment-based visas. There is also no required PERM process, wherein the Department of Labor must be convinced that there are no U.S. workers who could fill the same position.
National Interest Waiver (For EB-2 Visa)
A national interest waiver (NIW) is a petition you can file when applying for an employment-based, second-preference visa – also known as the EB-2 visa.
An NIW allows aliens to obtain an EB-2 without the otherwise-required labor certification, which means they may obtain a green card without sponsorship from an employer. The labor certification process can be long and costly. See if you qualify for a national interest waiver.
