About Work Visas

Permanent Workers Visa (Green Card)

Some categories of work visas require individuals to have a permanent job offer from a United States employer. This employer will be considered the sponsor/petitioner and will need to file a petition with USCIS on behalf of the worker. If no job offer is required, we may file a petition on the worker’s behalf.

EB-1 (Employment-Based, First Preference) Visa

An EB-1 visa is an employment-based immigrant visa that provides the holder with permanent residency. This visa is granted to immigrants who possess extraordinary abilities and have proven national or international acclaim.

Many immigrants desire the EB-1 visa because the wait time is often a lot shorter than for other employment-based visas. There is also no required PERM process, wherein the Department of Labor must be convinced that there are no U.S. workers who could fill the same position.

EB-2 and EB-3 (Permanent Work) Visas

Approximately 140,000 visas are available each year for individuals seeking to immigrate to the United States for employment-related purposes. With the right combination of experience, education, and career skills, you or your employees could be eligible to become a permanent resident in the United States.

Certain visas require that you already have a job offer from an employer in the United States. In this case, the employer is your sponsor and must acquire a labor certification from the U.S. Department of Labor (DOL).

National Interest Waiver (For EB-2 Visa)

A national interest waiver (NIW) is a petition we can file when applying for an employment-based, second-preference visa – also known as the EB-2 visa.

An NIW allows immigrants to obtain an EB-2 without the otherwise required labor certification, which means a green card may be obtained without a sponsorship from an employer. The labor certification process can be long and costly. See if you qualify for a national interest waiver.

H-1B (Specialty Occupation) Visa

Through the H-1B visa, employers can hire qualified workers from outside the country temporarily for specialty occupations. There is a cap of 65,000 H-1B visas every fiscal year; those with a U.S. master’s degree or higher have an additional 20,000 petitions. O-1 (Extraordinary Abilities) Visa

L-1A Visa

An L-1A visa allows foreign executives or managers to be transferred to their company’s offices in the United States in a non-immigrant capacity. Typically, the L-1A visa holder’s spouse and children under the age of 21 can join him or her in the United States with an L-2 visa.
