EB-2 Visa Requirements

The EB-2 visa category is divided into two subgroups, each with its own distinct set of requirements. EB-2 visa subcategories include:

EB-2 Advanced Degree

Applicants must hold an advanced degree or its foreign equivalent. Alternatively, applicants may have a bachelor's degree or foreign equivalent, complemented by five years of progressive, post-baccalaureate work experience in the field. Additionally, candidates must fulfill any other stipulations outlined in the labor certification, as applicable, by the priority date.

EB-2 Exceptional Ability

Applicants must demonstrate exceptional ability in the fields of science, arts, or business. Exceptional ability is defined as a level of expertise superior to what is commonly found in sciences, arts, or business. Additionally, candidates must fulfill any specified criteria outlined in the labor certification, where applicable.

To qualify for this category, you must meet at least three of the following:

  • A degree or similar award related to your area of exceptional ability obtained from an educational institution such as a school, college, university, or other institution.
  • Documentation from current or former employers verifying at least 10 years of full-time experience in your field.
  • A license or certification that authorizes you to practice your profession.
  • Proof of compensation for services that demonstrate your exceptional skill level.
  • Membership in a professional association relevant to your field.
  • Recognition from professional organizations, government entities, or peers for your contributions and achievements within your area of expertise.
  • Other evidence that substantiates your exceptional ability.

EB-2 National Interest Waiver (NIW)

Furthermore, applicants can apply for a National Interest Waiver (NIW), exempting them from the job offer and labor certification requirements if it serves the national interest. This allows you to secure a green card independently, without employer sponsorship.
